What Does AD&D Cover?
AD&D insurance pays beneficiaries if their loved one’s death or dismemberment is the direct result of an accident. Many people add AD&D to their life insurance. It may be a separate policy or an add-on known as a “rider” to their coverage.
AD&D will pay the policy holder or a beneficiary a certain amount of money if a fatal accident occurs or an accident causes the policy holder to lose his or her:
- Eyesight,
- Speech,
- Hearing, or
- Limb
There are some exclusions to AD&D coverage. Some of these include death during surgery, death caused by a drug overdose, drinking and driving, or other specific situations.
Dismemberment coverage is generally paid on a “per-member” basis. In other words, the benefits paid depend on the specific injuries the person sustained.
A Case Example
The Life Insurance Lawyers represented a woman who was a named beneficiary in her husband’s accidental death policy. When her husband was killed in a vehicle accident, the insurer denied her claim for death benefits. The company argued that toxicology and autopsy results revealed that her husband had an illegal blood alcohol content. Witnesses also noted that the insured was drinking at a bar prior to the accident. The policy contained an intoxication exclusion, which denies payment of the death benefit when the insured’s intoxication contributed to the accident. The Life Insurance Lawyers utilized their knowledge of the relevant case law to argue that the alleged fact of intoxication did not warrant denial under the accidental death policy. They were successful in getting the insurance company to reverse its denial. The company ultimately paid the full death benefit with interest as well as an additional benefit for child care expenses.
While each case is different and yields different results, the Life Insurance Lawyers use their legal experience and medical knowledge to make persuasive arguments with the goal of getting their clients the benefits they deserve.
